Fluc Up Tools Terms and Conditions
Section 12 of the General Terms and Conditions
12.1 The Fluc-Up Tool, and any bets in respect of which the Fluc-Up Tool is available, shall be governed by these General Promotions Terms and Conditions, in addition to the Account and Betting Platform Terms of Use and the Betting Rules.
12.2 NEDS may, in its sole discretion, make available the Fluke-up Tool to Eligible Customers for use in selected markets, events or bet types.
12.3 The Fluc-Up Tool is not available for use in conjunction with any other promotional offer or promotional tool.
12.4 The Fluc-Up Tool is only available for single ‘Win’ bets. The ‘Win’ portion of an e-Way bet is not eligible for use with the Fluke-up tool.
12.5 The Fluke-Up Tool is not available for use on ‘Multi-bets’, ‘Exotic bets’ or ‘Future bets’ as these terms are defined in the NEDS betting rules.
12.5 The maximum eligible bet that can be used with the Fluke-Up Tool is $500.00
12.6 The Fluke-Up Tool is only available for use at qualifying Australian and New Zealand metropolitan racing events (thoroughbred gallopers, trotters and greyhounds).
12.7 The Fluke-Up Tool is only available for bets placed on the Neds betting platform (either the desktop version or using the Neds smartphone app) and is not available in relation to bets placed by telephone.
12.8 The Fluke-Up Tool is available for use only once per race.
12.9 If the Fluke-Up Tool is made available for use in conjunction with your Eligible Bet, then:
(a) you will see the Fluke-Up Tool button/icon below your selection on your ‘Quick Slip’;
(b) Once the bet on your selection has been accepted and reflected in your bet slip, you shall have the fluke on your selected runner by clicking on the ‘Fluke-Up’ button/icon (‘Fluke’)- There will be an option to use the up tool. -up request’);
(c) your fluke-up request must be made within 5 minutes of your bet being accepted as indicated by the countdown timer displayed next to your selection on your bet slip (the ‘fluke-up activation period’);
(d) If your Fluke-up request is made within the Fluke-up Activation Period, then if the market odds for your selected Runners at any point of time during the Fluke-up Activation Period fluctuate outward/upward ( market volatility data displayed on the Betting Platform), the odds for your selection will be automatically adjusted to the next highest volatility odds for your selection, which were in force at the time the bet was placed, so that If your selection is a Result/Winning bet, and you will be paid at the next highest swing odds, not the lower odds at which the bet was placed.
12.10 Your Fluked-up request will not be deemed to have been approved and processed by NEDS until you receive confirmation in your Bet Statement.
12.11 Once the Fluked-up request has been made and processed, your Fluked-up Tool shall be deemed to have been exercised, even if there is no market movement in the odds on your selection during the Fluked-up activation period.
12.12 If your connection to the NEDS Betting Platform between the time you submit a fluke-up request and the time you receive confirmation that the fluke-up request has been accepted or rejected (a ‘Pending Request’) timed out or other intermittent failure), you cannot use the Fluke-Up Tool on any other bet until your bet statement shows a pending request confirmation.
12.13 Each Eligible Customer will be allocated a fixed number of uses of the Fluke-up Tool in each 24 hour period at the sole discretion of NEDS. The allocated quota for use of the Fluc-Up Tool will reset each day at midnight (AEST) and any unused quota for that day will expire and will not roll-over to the next day.
12.14 You may use the Fluke-Up Tool only once per race. The Fluke-Up Tool will be considered consumed and will not be available for use with any other bets on the day if there is a timeout or other intermittent failure of your connection to the Neds Betting Platform between the time it is activated . The fluke-up tool for the race as applied to your bet as long as it appears on your bet slip.
12.15 NEDS reserves the right to change, suspend or remove the availability of the Fluke-Up Tool at any time.
12.16 NEDS reserves the right to void any Bets placed using the Fluke-Up Tool if there is any clear and manifest error by NEDS and/or any breach of the Terms and Conditions by the Customer.
